1. Agreement to Terms

By accessing or using UpgradeYourself.app ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

UpgradeYourself is a health optimisation platform that provides:

  • AI-powered supplement and peptide recommendations
  • Health data tracking and analysis
  • Educational content about health optimisation
  • Protocol management tools

The Service is for educational and informational purposes only. It does not provide medical advice, diagnosis, or treatment.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must not share your account with others
  • You are responsible for all activities under your account
  • You must notify us immediately of any unauthorised access

5. Encryption Passphrase

The app includes a browser-side passphrase feature for protected content. This does not cover every account record or prevent server-side AI processing. You are solely responsible for remembering this passphrase. If you lose it:

  • We cannot recover your encrypted data
  • You will need to reset your account and start fresh
  • All previously encrypted data will be permanently inaccessible

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorised access to our systems
  • Interfere with the proper functioning of the Service
  • Upload malicious code or content
  • Impersonate others or misrepresent your affiliation
  • Scrape or harvest data from the Service
  • Use the Service to provide medical advice to others

7. Intellectual Property

The Service, including its content, features, and functionality, is owned by UpgradeYourself and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

8. User Content

You retain ownership of any content you submit to the Service. By submitting content, you grant us a limited license to store and process it solely to provide the Service to you. Account records are processed on our servers to provide the service. When you request AI features, relevant content is also sent to our AI provider, as described in our privacy notice.

9. Third-Party Links and Services

The Service may contain links to third-party websites or services, including supplement retailers. We are not responsible for the content, privacy policies, or practices of third parties. We may receive affiliate commissions from some product links.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UPGRADEYOURSELF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR HEALTH OUTCOMES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless UpgradeYourself and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may terminate your account at any time by deleting it through the Settings page. Upon termination, your right to use the Service immediately ceases.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use after such notification constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with Australian arbitration rules.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
